WHOOP just drew a line in the sand.
And, the decentralized health battle just escalated.
Last month, the FDA issued a warning letter over its Blood Pressure Insights feature, arguing the wearable had crossed into unapproved medical-device territory.
This month, WHOOP responded.
They’re not backing down.
CEO Will Ahmed put it plainly: “We do not plan on removing the feature from our app. The law is on our side.”
This isn’t just a regulatory disagreement.
It’s a power struggle over the future of health.
Here’s what really happening:
The FDA is flexing authority over trend-based, non-diagnostic wellness features.
WHOOP is invoking the 21st Century Cures Act, which protects wellness tools that don’t diagnose or treat disease, to defend BPI.
Both sides are citing “safety”.
But underneath it all, a deeper battle is brewing:
Decentralized, data-driven, prevention-first, consumer-led health
vs.
Centralized, top-down, disease-centric sick-care built around regulation and control
And, make no mistake — this is all about who sets the rules of the game.
And, that battle is now public.
Intended use ≠ perceived use: If your tool feels clinical, even with disclaimers, you may get treated like a medical device by regulators.
FDA’s stance is evolving: The FDA previously allowed both general wellness and clinical-grade versions of tools like heart rate monitors. But, the line is blurring. Blood Pressure Insights feels diagnostic. Even with disclaimers, if it looks clinical, they’ll treat it like a device.
The ecosystem: Founders, investors, clinicians, and policymakers are all watching closely. The precedent set here will ripple across wearables, wellness AI, and beyond.
If WHOOP is forced to remove the feature, the chilling effect will ripple across health tech.
If WHOOP wins, it reinforces and strengthens the legitimacy of a decentralized, data-informed, prevention-first, proactive wellness model, and forces regulators to modernize.
We need:
Clearer legal language around intended use
Open-source frameworks for ethical wellness AI
Proactive coalition-building across founders, investors, clinicians, and policymakers
Radical consumer-first transparency so that users understand what data can/cannot do
The FDA must evolve with the industry, not against it.
And, WHOOP is forcing that conversation into the open.
As decentralized wellness gains market share, the system moves to regulate, restrict, and reclaim control, often under the banner of “safety”.
Sometimes that’s valid.
But, sometimes, it’s protectionism in disguise.
The future of health is:
Decentralized. Data-informed. Prevention first.
We will either shape it together or watch it get regulated out of existence.
Where should the line be drawn between prevention-first insights and regulated diagnostics—and who should get to draw it? What do you think? Let me know in the comments.
